LOSING UPND Matero parliamentary candidate Tom Michelo has urged the Lusaka High Court to nullify the election of Miles Sampa.

In a petition filed in court, Michelo said Sampa, who was declared winner of the August 12, 2021 Matero constituency parliamentary seat, was not validly elected.
Sampa won the election with 55,612 votes while Michelo got 33,598.

However, Michelo who has also sued the Electoral Commission of Zambia (ECZ), said the election in Matero was characterized with electoral offences such as violence, bribery and publication of false statement.
Michelo said Sampa’s agents attacked and caused serious injuries on UPND officials and other individuals.

He claimed that the agents for Sampa also damaged a motor vehicle.

The petitioner said Sampa on the eve of the election distributed campaign materials and 10KG bags of mealie meal with his name in a bid to solicit votes.

Michelo contended that this action by Sampa breached the Electoral Process Act and the Electoral Code of Conduct.

The petitioner also alleged that Sampa committed prescribed electoral offences in the capture and entry of valid votes cast in the totalling centre at Matero Boys Hall, that influenced the outcome of the election.

Michelo seeks a declaration that the ECZ did not conduct elections in Matero with due diligence and care. He also wants the court to order for the ballot papers to be scrutinised, verified and recounted.

Further, Michelo wants Sampa’s election to be nullified because the election was not free and fair.
