A JUDGE has allowed Patriotic Front(PF) presidential hopeful Miles Sampa to institute contempt of court proceedings against Given Lubinda and Raphael Nakacinda.
Mr Sampa applied for leave to commence contempt proceedings against the duo whom he accused of disregarding a court order earlier granted to him.
In February this year, Lusaka High Court Judge Timothy Katanekwa granted Mr Sampa an interim injunction halting his suspension from the PF pending hearing of a court case.
Judge Katanekwa also restrained Mr Lubinda, who is acting PF president and others from holding themselves in those positions until final determination of the lawsuit against them.
But Mr Sampa last week informed the court that Mr Lubinda and Mr Nakacinda, disregarded a court order preventing them from carrying out activities in their respective positions.
He said this follows Mr Lubinda’s decision to appoint Mr Nakacinda as part secretary general.
Mr Sampa contends that the according to the court order of February, the duo were restrained from carrying out party functions and that their current actions were disrespectful to the court.
He added that disregarding the court order undermined the powers of the court interferes with the process of administering justice and brings the name of the court into shame.
The Matero legislator said in an ex-parte(one sided) order for leave to issue committal proceedings, if nothing is done to tame the actions of Mr Lubinda and Mr Nakacinda, the court’s reputation will continue to be disrespected.
He then applied that he be allowed to institute contempt of court proceedings against the duo, a plea which the court granted.
“It is hereby ordered that leave be and is hereby granted to issue committal proceedings against given Lubinda and Nakacinda,” the court order reads in part.
