CONSTITUTIONAL Court judge Maria Kawimbe has highlighted the vital role of administrative election management in safeguarding human rights and preserving the integrity of the voting process.
Judge Kawimbe has also noted that although management of elections is a role reposed on the Electoral Management Body (EMB), the role of electoral courts still has significance.
She said this during a high level colloquium of the Constitutional Council held in Paris on October 16th, this year.
“Although the management of elections is a role reposed on the Electoral Management Body (EMB) , the role of electoral courts still has significant prominence in the administrative management of the elections. Administrative management of elections is important in protecting human rights and ensuring that the right to vote is not undermined through electoral mismanagement,” she said.
Judge Kawimbe noted that the court’s role in promoting public confidence in the integrity and professionalism of electoral management and acceptance of election results by referring to some electoral landmark judgments passed by the African judiciaries.
She also noted the African voice in the discourse of strengthening democracy in the context of electoral justice and election dispute resolution mechanisms.
Judge Kawimbe commended African countries for preferring the use of courts in settling hotly contested electoral disputes, which are considered a peaceful means ,as opposed to undemocratic methods usually characterized by violent means such as coup d’etat.
This is according to a Statement issued by First Secretary Press at the Zambian Embassy in Paris, France, Naomi Mweemba.
