LUSAKA High Court Judge Kazimbe Chenda has threatened to lock up Marshlands Consortium Director, Tobias Haanyimbo Milambo, for failing to answer questions in Court.
This is in a matter in which Tomorrow Investments Chief Executive Officer, Chanda Katotobwe and his wife, Felistus Kabwe Chibamba have sued the 3 Marshlands Consortium directors for the restitution of Ultimate Insurance Company, whose shareholding was fraudulent changed.
Judge Chenda threatened to lock up Milambo, after noting various evasions and inconsistencies when answering questions in cross examinations.
And in his testimony, Milambo conceded that Marshlands Consortium Ltd never paid any money for purchase of shares of Ultimate Insurance Ltd but paid in kind.
When asked to give details of the payment in kind that Marshlands Consortium paid, Milambo failed to produce any evidence of the payment.
Meanwhile Milambo denied that he was part of the people that forged Valuations and Deeds of transfers on behalf of Marshlands Consortium Ltd which were submitted to Ultimate Insurance Ltd.
When asked why he has not produced any copy of the Valuations reports despite all the cases including criminal proceedings requiring these reports to clear his name and Marshlands Consortium Ltd, Milambo answered that he didn’t see the need for the documents.
And on a document that is shows a forged signature of Mrs. Felistus Kabwe Chibamba, Milambo agreed that he had not brought any evidence to dispute the forgery of Felicitas K Chibambas Signature.
He also admitted that assertions that Felicitas K Chibamba’s Signature was forged is unchallenged.
The matter has been adjourned to 9th November, 2020 for continued trial.
